Liaoning Provincial Party Committee and Government attach great
importance to the construction of soft investment environment
in the province.
The provincial party committee and government have decided to
name the year 2000 as the province's year of further improvement
of investment environment, and put the focus of work on enhancing
the administrative action of government departments according
to law and the improvement of service quality and work efficiency,
in order to create an excellent external environment for foreign
investment and the production and management of foreign investment
companies.
1.Insist on the system of the provincial foreign investment joint
conference. Continue to insist on the system of the provincial
foreign investment joint conference. The joint conference is held
once every three months. It is presided by the vice governor in
charge of foreign investment joined, and is participated by the
leaders of the departments concerned of the provincial government.
The main purpose is to research on and solves the key problems
of the utilization of foreign investment, and the management and
production of foreign investment companies.
2.Implement the open action system, and simplify the approval
procedures. The foreign-related departments of all levels of government
of the province must make public the function, responsibility,
work standard and procedures of their own departments, including
the application procedures, the work flow formula, the materials
needed, and the deadlines, etc., especially whether or not a fee
is charged and the standard of payment. For certain competitive
areas, "one- stoptation" service should be promoted.
3.Promote the commitment system of social service, and implemented
extended services. If aAll the key social service departments,
such as public utility, urban constructions, heat supply, business,
post, communications, electric supply, health, finance, port and
tourism, etc., if they are involved with the direct service for
enterprises, they must implement commitment system, and publish
the contents, standard, obligation and service time limit, etc.,
of the commitment, and accept the supervision of the society and
the enterprises. Such port inspection departments as the customs
office, the commodity inspection and quarantine bureau, the maritime
supervision and the frontier inspection must all insist on the
implementation of the 24-hour duty system for international liners,
the extra shift appointment system for commodity declaring and
passing on holidays, and the convenient and preferential treatment
for companies with good credit to pass the customs and inspection.
4.Enhance the development of local foreign-related regulations.
The province We should carry out a thorough check on all the regulations
and documents, and such regulations against the further opening
to the outside world must be immediately revised or abolished.
The province We should also further formulate and perfect the
local rules and government regulations, and improve the legitimate
environment of the foreign investment in our province.
5.Implement the registered protection service for key foreign
investment companies. "The Foreign Investment Companies with
Outstanding Contributions" appraised by the departments concerned
of the provincial government should be specially protected according
to special protection policies. Except for special law enforcement
inspection, all the ordinary activities like visit, inspection,
training or contest must be reported to and approved by the company's
local foreign trade and economic cooperation department. Other
people are not allowed to enter the company.
6.Implement the examining and approving system in the issuance
of documents, training and conference. As for the documents issued
by various functional departments of the provinceial, the foreign
trade and economic cooperation departments at the same level before
the issuance of the documents, whenever there are clauses concerning
foreign investment companies, these terms must approve municipal
or county government. Unapproved documents are not allowed to
be issued. Foreign investment companies do not have to abide by
the documents without clear indication that they are applicable
to foreign investment companies.
7.Regulate the inspection and fee charges on foreign investment
companies. If departments concerned must carry out an inspection
and impose a fee charge on foreign investment companies, they
must strictly follow the laws and regulations. If such action
belongs to an enforcement inspection, the inspectors must show
the documents for administrative enforcement; if such action belongs
to fee charge, the collector must show the Fee Charge License,
and fill out the Foreign Investment Company Fee Charge Supervision
Card of Liaoning Province, and strictly follow the standards set.
Two or more people must jointly carry out the inspection and fee
charge activities.
The inspectors and fee collectors must wear uniforms in case they
are obliged by the national law to wear them in their administrative
activities. If they do not carry out such activities according
to the abovementioned requests, the company has the right to decline
the reception, and may lodge a complaint to the local or provincial
foreign investment complaint-lodging center.
8.Strictly forbid the paid or covert paid official actions of
government agencies. The functional departments of the provincial
government must not execute paid service for foreign investment
companies by using their power. The companies or institutions
attached to government agencies are also not allowed to covertly
fees with the authority given by such government departments.
9.Further improve the handling of the complaints lodged by foreign
investors and their companies. The leaders of all levels must
attach importance to the complaints lodged by foreign investors
and their companies, and the foreign investment company complaint
lodging centers must enhance theirthe ability to coordinate such
cases, carefully solve such disputes, and raise the rate of satisfaction
of such complaint cases.
10.Establish regular meeting system for dialogs with foreign investors.
The departments concerned of the provincial and municipal governments
must all insist on the implementation of a the regular meeting
system for dialogs with foreign investors. Every year, such departments
must sponsor several investment environment symposiums attended
by the foreign investors, and the board directors and CEOs of
the foreign investment companies, to directly listen to the suggestions
and proposals by foreign investors and their companies, and to
communicate with themn and help them solve the problems.
